Description


As an independent section within the Office of the Secretary, the Office of Administrative Hearings (OAH) carries out its mission to conduct fair and impartial mining and environmental administrative hearings and other proceedings as required by statute. In doing so, OAH helps ensure that important mining and environmental disputes, all impacting the regulated community as well as the health and safety of Kentucky’s citizens and the environment, are heard pursuant to statute by qualified and experienced administrative hearing officers.


OAH provides due process to those seeking to exercise their statutory rights to contest Cabinet decisions. The Environmental Administrative Hearing Officer will be responsible for conducting hearings and other proceedings involving mining and environmental issues of a complex and sophisticated nature, and making written reports and recommendations to the Secretary regarding the same.


This is an Interim position. An Interim position means a position established to address a one-time or recurring need of less than nine (9) months duration and is exempt from the classified service under KRS 118A.115.

Minimum Requirements


EDUCATION: See Special Requirements.


EXPERIENCE, TRAINING, OR SKILLS: Must have three years of experience practicing law or serving as a law clerk with a State or Federal judge following completion of law school. (Two years of the required experience must be in a natural resources field.)


Substitute EDUCATION for EXPERIENCE: A Master of Law degree will substitute for one year of the required experience.


Substitute EXPERIENCE for EDUCATION: NONE


SPECIAL REQUIREMENTS (AGE, LICENSURE, REGULATION, ETC.): Must possess and maintain a valid driver's license prior to employment in this job classification. Must be licensed to practice law in the Commonwealth of Kentucky. Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this job classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s) or other credentials.


Working Conditions


Incumbents working in this job title primarily perform duties in an office setting. Minimal travel is required.
